Three rules apply to almost all of them, so the individual pages assume rather than repeat them. Most Florida negligence claims arising after March 2023 must be filed within two years. Under modified comparative negligence, a person found more than 50 percent at fault generally recovers nothing, and at 50 percent or less recovery is reduced by their share. And in a crash case, personal injury protection pays the first medical bills regardless of fault, but it is capped and it runs on a 14-day treatment deadline.

Vehicle and Traffic Collisions

Most Florida injury claims start here, and most of them run through the same two systems: personal injury protection for the first medical bills, and a liability claim against the at-fault driver for everything PIP does not reach.

On the Water

Vessel claims are not road claims. Operator and owner liability, rental company practices and post-incident reporting duties all differ, and federal maritime law can displace Florida law entirely.

In the Air

Aviation claims are argued in the language of federal regulations rather than ordinary negligence. They also carry an eighteen-year repose that can bar the manufacturer claim before a family has finished grieving, which is why these cases are decided in their first weeks.

Property and Premises

These turn on what the owner knew and when. Since 2010 an injured customer generally has to show the business knew or should have known about the hazard, which usually means proving how long it was there.

Catastrophic Injuries

Where an injury is permanent, the claim has to account for decades rather than for a course of treatment. These cases are built on life care planning and expert economic evidence, and they should not be valued while the picture is still changing.

Medical Negligence

Both carry procedural requirements ordinary negligence claims do not: a pre-suit investigation and a corroborating expert opinion before a case can be filed at all. Birth injuries add a further step, because a state compensation plan may replace the right to sue entirely.

Abuse and Institutional Failure

These claims are about an organization rather than only an individual: who it hired, what complaints it received, and whether it made the reports the law required. The deadlines are unlike anything else on this page, and for childhood sexual abuse there may be none at all.

Insurance and Coverage Disputes

Sometimes the obstacle is not the person who caused the harm but the insurer that should be paying for it. These are claims about how a claim was handled, and they are assembled out of the record the underlying case creates.

Work Sites and Products

Where someone other than your employer caused the harm, a civil claim can run alongside a workers’ compensation claim, and it is the civil claim that reaches pain and suffering.

Fatal Claims

Florida’s Wrongful Death Act requires the claim to be brought by the personal representative of the estate, on behalf of survivors whose losses the statute defines.

Where the Deadlines Differ

The two-year rule is the general case rather than the whole picture. Medical malpractice carries a pre-suit investigation requirement and a statute of repose. A claim against a city, county or state entity requires written pre-suit notice before suit can be filed, and recovery against the entity is capped. A cruise or vessel claim may be governed by the passenger ticket, which commonly requires notice within six months and suit within one year in a court the line names.

Whichever category fits, something is usually already running. Evidence has its own clock too: commercial vehicle telematics, store surveillance and ride maintenance logs are all retained on fixed cycles measured in weeks. A preservation demand sent early is often worth more than any argument made later.

Plenty of claims sit across more than one of these, and some do not obviously match any of them. A crash caused by a delivery driver on a construction site involves three of the groups above. Very likely yes. These are categories of claim rather than a closed list, and many cases sit across several of them at once. If the injury was caused by someone else’s negligence anywhere in Florida, the free case review will tell you whether there is a claim worth pursuing.

Does the type of claim change how long I have to file?

It can, substantially. Most Florida negligence claims arising after March 2023 carry a two-year deadline, but medical malpractice adds a pre-suit investigation requirement, claims against government entities require written pre-suit notice, and cruise claims are often governed by a ticket contract with a one-year window.

Do you charge differently for different practice areas?

No. Every case is handled on contingency on the same basis: nothing upfront, and no attorney’s fee unless we recover. Clients may remain responsible for costs and expenses as described in the written fee agreement, and all fee terms are provided in writing before you sign.

Do you handle cases outside Tampa?
